The plan for the plant was studied by the Environmental Impact Assessment (VIA) and a special permit was drawn up and was to be approved for environmental compatibility by The Department of Environment and Environmental Conservation, the Ministry of Cultural Heritage and also by the Regions in question.

In the Study on Environmental Impact, which had singled out, researched and examined all the environmental factors potentially involved, the following aspects were looked at in great detail:
• water consumption and water drainage
• atmospheric emissions and air quality
• the micro-climate in the surrounding area
• sound emissions and the acoustic climate
• electro-magnetic fields
• placing the site in its natural setting
• architectural and archaeological heritage
• the natural eco-systems
• measures taken to eliminate or reduce unwanted effects
• the eco-compatibility running the plant
• the environmental monitoring projects

After the study the VIA Commission pronounced, in the Decree DEC/DSA/2004/00148 on 02/03/2004, a favourable opinion on the environmental compatibility of the plan to construct the plant. 

The decree stated that the plant, using the best technology which currently exists on the market, does not run any risk for the environment and for the public health.

In addition, in the Directorial Decree no. 55/04/2004, the Ministry of Economic Development gave the authorisation to Rizziconi Energia SpA to construct and run the plant.
